Wallet services are provided by HOLE TECH SOLUTION Pvt. Ltd. pursuant to PhonePe issued by the RBI.

Users/Client/Employer: A person or company that pays to get their work done. Please note that there is no work Physical in nature is being assigned or to be posted by Client. For details of work verticals available with us, website may be referred.

Expert: A person or company that receives payment for the work done as posted by Client/employer.

Work bidder provides for secure Wallet services for complete transactions.

After simple registration, Users/Client/Employer can post the details of work to be accomplished under the tab “Work Post”. He may also indicate the Budget within which he wants his work to be done and time frame for work completion as he desires.

After work is post , it will be reflected under the tab “Work List”. Against the work list row, a self-generated bid Number will appear along with estimated amount. After examination, Work get approved by work bidder team. In the same row at the right corner, there is a hyperlink under icon ₹ to pay for the work as estimated by the user/employer. By following the link, Users/Client/Employer can pay the estimated amount with GST from their wallet. Wallet needs to be charged appropriately by Users/Client/Employer as per requirement. After Work is post, expert can bid their price for the work. They have to deposit caution money through wallet system.

After successful work completion, payment is released to expert after obtaining consent form the Client/Employer. For details other terms & conditions below may be referred.

These Fixed Price Direct Contract Wallet Instructions apply to Fixed Price Direct Contracts active on “Workbider.com” the terms that apply to Fixed Price Direct Contracts will be outlined in our User Agreement, Fee and ACH Authorization Agreement, and Fixed Price Service Contract Wallet Instructions.

If a Client/Employer and Expert enter into a Fixed Price Direct Contract, these Fixed Price Direct Contract Wallet Instructions apply. These Wallet Instructions govern Wallet Accounts for Fixed Price Direct Contracts. Service Contracts are governed by the applicable Wallet instructions. To the extent permitted by applicable law, we may modify these Wallet Instructions without prior notice to you, and any revisions to these Wallet Instructions will take effect when posted on the Site unless otherwise stated. Please check the Site often for updates.

These Wallet Instructions hereby incorporate by reference the Terms of Service (“Terms of Service”). Capitalized terms not defined in these Wallet Instructions are defined in the User Agreement, elsewhere in the Terms of Service, or have the meanings given such terms on the Site. These Wallet Instructions do not apply to Fixed-Price Contracts or Hourly Contracts.

  • 1. DIGITAL SIGNATURE
    By clicking to accept a Direct Contract, Client and Expert are deemed to have executed these Wallet Instructions electronically, effective on the date Client/Employer clicks to accept the Direct Contract, pursuant to Indian IT ACT2000, section 5 and the Global and National Commerce Act (E-Sign Act) 15 U.S.C. Sec. 7001, as may be amended from time to time (the "E-Sign Act"). Doing so constitutes an acknowledgement that Client and Expert agree to conduct the transaction electronically, and are able to electronically receive.

    2. FUNDING WALLET
    By accepting a Direct Contract, Client/Employer agrees to deposit funds for the full amount of the Direct Contract. Funds deposited by Client’s/Employer remain in the Client’s/Employer’s Wallet Account until they are released to the Expert Wallet Account or released to the Client/Employer Bank Account. Workbider.com will not release funds held in Wallet except as described in these Wallet Instructions.

    3. RELEASE AND DELIVERY OF AMOUNTS IN WALLET
    Client/Employer and Expert irrevocably authorize and instruct Workbider Wallet to release applicable portions of the Direct Contract Wallet Account (each portion, a “Release”) to their Expert’s Wallet Account or Client/Employer’s Wallet Account, as applicable, upon the occurrence of and in accordance with one or more release conditions provided below or as otherwise required by applicable law or the Terms of Service. If the funds are released to the Client/Employer , they will be automatically returned to the Client/Employer’s Bank Account through which Wallet fund was charged. The amount of the release will be delivered to the applicable Wallet Bank Account in accordance with Expert’s or Client/Employer’s instructions, as applicable, these Wallet Account Instructions, and the other Terms of Service.


3.1 RELEASE CONDITION

Used in these Wallet Account Instructions, “Release Condition” means any of the following:

  • 1. Expert clicks the “SUBMIT” tab after work completion and Client/Employer clicks “CLOSE” tab , then Workbider releases funds to Expert.

    2. Client/Employer does not take any action for 7 days after Expert submits the work and autogenerated message to this effect is sent to Client/Employer, in that case Expert and Client/Employer agree that Workbider Wallet Account is authorized and irrevocably instructed to immediately release to Expert, the amount associated with the work.

    3. After receipt of autogenerated message that work has been submitted, if Client/Employer initiates a dispute within 7 day through e-mail to Worbider on support@workbider.com , pursuant to Section 6 before a payment has been released to Expert, in that case the funds will be released in accordance with the outcome of the dispute.

    4. Expert can cancel the contract before estimated date after mutual consent with Client/Employer, in that case, the funds are released to the Client/Employer.

    5. Client/ Employer can cancel the contract before the bid end date, in that case full funds are released to the Client/Employer.

    6. After work is assigned, Client/ Employer can only cancel the contract after consent of Workbider and in that case, funds are released to the Client after deduction of 25% estimated amount.

    7. Issuance of the final order of a court or arbitrator of competent jurisdiction, in that case the funds will be released in accordance with such order.

    8. We believe, in our sole discretion, that if any fraud, an illegal act, or a violation of Workbider’s Terms of Service has been committed or is being committed or attempted, in such case, Client/ Employer and Expert irrevocably authorize and instruct Workbider Wallet Account to take such actions as we deemed appropriate in our sole discretion and in accordance with applicable law, in order to prevent or remedy such acts, including without limitation to return the funds associated with such acts to their source of payment.

4. INSTRUCTIONS IRREVOCABLE

On the occurrence of a Release Condition, Client/Employer and Expert are deemed to and hereby agree that the instruction to Workbider Wallet Account to release funds is irrevocable. Without limiting the foregoing, Client/ Employer’s instruction to Workbider Wallet Account to pay an Expert is irrevocable. Such instruction is Client/Employer’s authorization to transfer funds to Expert from the Client/Employer Wallet Account or authorization to charge Client/Employer’s Payment Method. Such instruction is also Client/Employer’s representation that Client/Employer has received, inspected and accepted the subject work or expense. Client/Employer acknowledges and agrees that upon receipt of Client/Employer’s instruction to pay Expert, Workbider Wallet Account will transfer funds to the Expert and that Workbider Wallet Account and other Affiliates have no responsibility to and may not be able to recover such funds. Therefore, and in consideration of services described in this Agreement, Client/Employer agrees that once Workbider Wallet has charged Client/Employer’s Payment method, the charge is non-refundable.


5. REFUNDS AND CANCELLATIONS

Client/Employer and Expert are encouraged to come to a mutual agreement if refunds or cancellations are necessary. In the event that Client/Employer and Expert are unable to come to an agreement on their own, the following process will apply.

6. DISPUTE ASSISTANCE PROGRAM

If Client/Employer and Expert fail to come to a mutual resolution by way of the refund and cancellation process, Workbider provides the dispute assistance program administered by Workbider and described in this Section 6 (the “Dispute Assistance Program”) as a mechanism to resolve the dispute. If the funds in dispute are held in Wallet Account, the Dispute Assistance Program will proceed as described in Section 6.1. The Dispute Assistance Program is not available for disputes filed or initiated past the Dispute Assistance deadlines, as set forth in Section 6.1, as applicable. The Dispute Assistance Program is offered as a form of non-binding assistance to facilitate communication and potential resolution of disputes between Client/Employers and Expert the Dispute Assistance Program as administered by Workbider in this Section 6 does not evaluate the quality or functionality of work and cannot render binding judgment or determination as to the parties’ respective rights to the disputed funds.

6.1 DISPUTE OF FUNDS IN WALLET

This Section applies to disputes filed by Client/Employers or Expert over funds that are held in Wallet as of the date the dispute is filed (“Wallet Dispute”). In the event of a Wallet Dispute, funds in Wallet will remain in Wallet holder while the Dispute Assistance Program is being administered. The Dispute Assistance Program for a Wallet Dispute will be administered as set forth below:

  • 1. Wallet Dispute Assistance Deadline: Wallet Disputes must be received before the funds in Wallet Holder have been released in order to be eligible for the Dispute Assistance Program under this Section. Disputes over funds that have been released from Wallet may be eligible for assistance under Section 6.2 below.

    2. Filing A Dispute :-

    (a). Expert & Agencies: Expert and Agencies may initiate a Wallet Dispute after 3 calendar days of when a Client/Employer ends a project.

    (b). Client/Employers: Client/Employers may initiate a Wallet Dispute by requesting a money refund through email on support@workbider.com. then case will be referred to the admin of Workbider.

    3. Notice of Wallet Account Dispute: Once a dispute has been filed, the Wallet management team that administers the Disputes Assistance Program (“Wallet Disputes Team”) will notify Client/Employer and Expert in writing of the Wallet dispute via ticket and request information and supporting documentation from the parties (“Notice of Wallet Dispute”).

    4. Lack of Participation: Client/Employer and Expert must respond to the Notice of Wallet Dispute within 3 calendar days. If one party does not timely respond to the Notice of Wallet Dispute, Client/Employer and Expert authorize and irrevocably instruct Workbider Wallet Account to release the funds in Wallet to the responding party.

    5. Non-Binding Assistance: After both Client/Employer and Expert respond to the Notice of Wallet Dispute, the Wallet Disputes Team will review the documentation submitted and any information available on the Site that pertains to the dispute. The Wallet Disputes Team will facilitate communication between the parties and help assess whether mutual resolution is possible. The Wallet Disputes Team does not evaluate the quality or functionality of work and cannot render binding judgment or determination as to the parties’ respective rights to the disputed funds.

    6. Resolution of Wallet Account Dispute: If the Wallet Disputes Team is able to facilitate a resolution between Client/Employer and Expert, and if Client/Employer and Expert agree in writing to the resolution, Client/Employer and Expert agree that Workbider Wallet Manager is authorized and irrevocably instructed to immediately release Wallet funds in accordance with the agreed-upon resolution. This will result in a closure of the Wallet dispute ticket.

    7. No Resolution: If no resolution of the Wallet dispute has been reached within 10 calendar days of the Notice of Wallet Dispute, or if the Wallet Disputes Team determines in its sole discretion that no resolution between the parties is possible through the Dispute Assistance Program, Client/Employer and Expert agree that Workbider Wallet Account is authorized and irrevocably instructed to immediately release Wallet funds in equal amounts to Client/Employer and Expert. This will result in a closure of the Wallet Dispute ticket.

7. NOTICES

All notices to a User required by these Wallet Instructions will be made via e-mail sent by Workbider to the User’s registered e-mail address. Users are solely responsible for maintaining a current, active e-mail address registered with Workbider, for checking their e-mail and for responding to notices sent by Workbider to the User’s registered e-mail address.

8. ABUSE

Workbider, in its sole discretion, reserves the right to suspend or terminate your Account immediately upon giving notice to you if Workbider believes you may be abusing the Dispute Assistance Program or as otherwise permitted by the Terms of Service. However, any Disputes for any Fixed-Price Contracts that existed prior to termination will be subject to the Terms of Service.

9. NO RESPONSIBILITY FOR SERVICES OR PAYMENTS

Workbider and Affiliates merely provide a platform for Internet payment services. Workbider and Affiliates do not have any responsibility or control over the Expert’s Services that Client/Employer purchases. Nothing in this Agreement deems or will be interpreted to deem Workbider or any Affiliate as Client/Employer’s or Expert’s agent with respect to any Services, or expand or modify any warranty, liability or indemnity stated in the Terms of Service. For example, Workbider does not guarantee the performance, functionality, quality, or timeliness of any Work Services or that a Client/Employer can or will make payments.

10. Pricing

Contract work is a bid income, Experts will bid and receive payment as determined by the clients. The Workbider.com charges only 5% of Expert’s earnings for each Bidded job for website development and service.
